Cnas and Lpns charged With Abuse Or Neglect of Patients - What to ExpectIn New Jersey, Certified Nursing Assistants (Cnas) and Licensed Practical Nurses (Lpns) are often accused by their patients or employers of neglect or abuse of patients in their care. Ordinarily these charges arise out of employment at nursing homes, resumption centers and hospitals. As a New Jersey attorney who represents many licensed or certified health care providers, I see a steep rise in the estimate of Cnas and Lpns who are fired from their jobs and who are threatened with placement on the New Jersey's "abuse registry" for alleged patient abuse or patient neglect. Many Cnas and Lpns lose their licenses for acts or omissions which appear to be minor, or even fabricated. These are the cases where attorneys can be the most helpful.

Some allegations of abuse and neglect are, of course, justified. Despite their training, caregivers sometimes show lack of knowledge or training or patience. Some are, in fact, neglectful or abusive. They may take statements from the caregiver, the alleged victim, witnesses (if any), the nurse in charge, the facility operator, and others. Unless the investigation reveals precisely no evidence (genuine or otherwise) to advise neglect or abuse, an accused worker will Ordinarily not be allowed to return to work. Sometimes they are suspended while the investigation (real or otherwise) is pending. More often they are fired immediately or within a few days. The facility understands how vulnerable it would be to a large lawsuit if another patient was victimized by the same caregiver while the investigation was pending.
Many Lpns, Cnas, Rns so accused believe that they were fired for no real reckon or without evidence. They are upset. They are sure that they cannot be fired without proof that they did something wrong. They are wrong. The large majority of caregivers in the work force are "at will" employees. This means they have no employment contract, and they do not belong to a union that has negotiated a public bargaining deal with the boss on their behalf.
"At will" employees may quit the job whenever they wish and for any reason, or even without giving a reckon or notice. But, sadly for them, the boss may fire "at will" employees for practically any reason, too. The nursing home operator does not Ordinarily have to wait for the outcome of an investigation in order to fire the employee. Of course, even an "at will" worker may not be fired for illegal reasons such as gender, disability, race, religion, nationality, sexual orientation. Employees who speak that they were fired for such illegal reasons will have the difficult burden of proving that to be true. Where the proof exists, an experienced attorney can help the fired worker to get the job back or even to sue for monetary damages.
Besides losing his/her job, other life-changing events may still await the caregiver. When a Can, Lpn or Hha is accused of abuse and neglect in New Jersey, the facility (nursing home, agency, rehab center, hospital), must study the event and narrative the matter to the division of health and Human Services in Trenton. Ordinarily within a month or so of the alleged events, the caregiver receives a consideration to attend an Informal Hearing in Trenton.
The Informal Hearing is the first of a series of hearings and appeals that may determine either the caregiver's license will be revoked and his or her name located on the Abuse and Neglect Registry. A Formal Hearing, If necessary, includes sworn testimony and documentary evidence. The hearings are designed to sort out exactly what happened; they enable the caregiver to by comparison or by comparison the operation or inaction.
Although it is not principal to hold an attorney for these hearings, it is Ordinarily wise to do so, if you can afford to. By instructing the caregiver on the procedures and how to give testimony, by explaining to the caregiver what is leading and what is not, by assisting the state to understand our side, the attorney makes the hearings go more smoothly, often with great results. At the Formal Hearing, it is Ordinarily principal to quiz, adverse witnesses. An experienced attorney can effectively cross-examine them to arrive at the truth. We were able to prove, for example, that a Cna had not abandoned an Alzheimer's patient, but, because of the configuration of a bathroom, the passing Rn could not see the caregiver in the room. another time we showed that the nursing home was wrongfully trying to get rid of an worker without having to pay for her unemployment benefits. In, New Jersey, Cnas and Lpns are often charged with abuse or neglect at residential care facilities. Some charges arise from minor incidents. Others reflect horrible facts. And to "declassify" a "Weapon System", they have to have already; invented; created; tested; the weapon itself. Then of course it must be in a "trial", lets say maybe easily in combat for real. That is in Iraq in "real time" and "real combat", or just tested in a designed test generally. The main operative here is two-fold. One is that they have to see that it is needed now! That speeds up the "testing". And they might see the weapon's potential in both this war in Iraq, and right now! That too would speed up, or "prioritize" the testing and placing the weapon into our Arsonal. But whether way, all you are being shown is the "dregs"!
The "dregs" if you will allow me to term it as such, is; in this case; a weapons theory that is sure sufficient "Future Weapon", but it is whether not practicle in application for Iraq, or not practicale for war at all! whether way, the theory you are viewing only has two positive uses now.
One use is to show you that your tax dollars is hard at work developing the arsonal that may "save a life", maybe of your own son or daughter! The whole point of this though is to "clue you in" to some things that you mght not be aware of, when you are viewing such "pablum for the masses". You will never easily see a "Future Weapon" for instance, that can kill millions or billions of people at one time! You didn't get to see and read about the Nuke Bomb, before it was dropped on Japan. Twice! Which was both a demonstration and a way to kill and maim, and more to the point, an actual testing in combat! Very requisite if you are going to go ahead and spend billions to "Weaponize" the item! You see, that is why they had to found larger, more deadly Nuke Bombs! The thing was just too small! And, the "enemy" was construction larger ones.
So, like the Isreali Air Force, who has it soldiery chain of command in place, also has an "on scene in combat" soldiery chain of command! Where they all, general; captian; sargent; airman first class; all fly and engage the enemy, yet you have no way to "take out" the commander in the air! For the simple presume that he could be any rank as mentioned! Neat! Right? You can't sabatoge and have killers in place before a war with the mission of illiiminating the commanders of any "wing", because you have no way to know who, what, or where he is!

It is in place to make money for the city, country, state, and Federal levels! You see, there is a "bounty" paid for each and every child they "kidnap" under this program. Now you know why you lose your child if they catch you not ready with a paper towel when it sneezes! For signing any paper placed in front of you whenever you are being "investigating", you are giveing up your rights! They now, since you agreed, to more than just an "arbitration", as it would be called in Business; you signed away all ownership to makeing decisons for the life and condition of your child. Now, he or she, is a "ward of the state". Where they will fall victim to experiments the Government are conducting!
You know, they have to easily test, in the field, any new "Future Weapon", such as a cemical or biological weapon? To do so, they need "subjects". To have "custody and control" of "wards of the state", they can now use that "genepool"! I ain't kidding you here either! Pitiful.
If we see that the someone in Command ain't. Then we see "Future Weapons" that aren't. And we see that we are fighting a war in Iraq, but not to win and leave! Then we can get a grip on reality! For some of us, that is not going to be easy! I know. I understand. You do as you see fit.
Here then is a short list of reality for us to consider;
The money and assets sold, from siezeure of property under the "drug war" gets divided! The city, if involved, get a bit. The State, all the time involved, get a handful. The Federal "real estate" is divided into "Districts". The heads of those districts (judicial here) gets a double portion! And then the Attorney normal is said to receive a "sizeable chunk", before passing the fund on to the President of the United States! Of course, all these items of earnings are not reported, because they are legislated to keep them off all tax or earnings statements. This is not my study, but it is taken liberally from a someone who, tiered of losign all to what he calls "criminal conscription to intiminate by Government Authorities". There are lots of things that I am interested in, ok?
You cannot loan money as a bank lender, on a new automobile. Not until you first "steal it'! (from actual court testimony) The title has to be "borrowed" by the bank of your choice, from other lending institutions, and to do that, they must "pledge" the title of the / your, new automobile! And it might be "maggots", instead of Prime Beef! Too bad. The soldiery commonly eats rather nicely, unless you are on a Ship which has "run over" its allocation for supplies. Then you are on your own! I'm not kidding you here either.
You also get "one hours rest". That does not mean a clean shower and clean sheets! It does not mean easily sleeping! It means; rest. You may have to sit down in a foxhole that got three inches of water in it. Or try to keep hold of the side of a liferaft, while the sharks circle to see who's arrival to dinner! But you get that one hour rest.
Not to mention, that if you are in the military, you can be kept there indifinatly! You do your enlistment time, and the President "finds" he needs to keep a few good men, he will cause your enlistment to be "for the duration", meaning until he gets a "durn' a' notion" to let you out! Of course in peace time you don't have to worry. Go ahead and make a career of it! On the last month, just before you "retire", they will jerk you to the "unfit" and "unqualified" list, where you are medically discharged, thus salvage tons of money for the "taxpayer"! Oh, I forgot to mention; if your an Officer; that means "for life" no matter what age, and whether an enlisted man (under a exact age) or an Officer, can be called up" to re-enter the soldiery aid once again, until "duration"!
what has all this got to do with you? Not one thing! Unless you have children or Grandchildren. Or unless you are of age, in the middle of eighteen and about sixty-five; then you are susceptable to being "drafted"! The new "draft" measurre, now soon to be law, if not already, says that they can do either-or; normal call up for all males and females in the middle of the ages of.. Or they can do a "spot check" enlistment. Where you are a graduate of some linguist school, or your a great programmer, or your an specialist in anything! One puny you are any of these, with a home, car, wife, children in school; the next moment you are not even a civilian! Well, actually, they; the Government, can do all that right now, war or no war!
So lets "re-cap." Who lies to you? Uncle Sam! Who grabs and kidnaps American Citizens outside this country? Uncle Sam does! Who can make your life hell on this earth, by taking and selling all you have? Uncle Sam! And then split the proceeds! Uncle Sam! Who kidnaps and terrorizes and murders others in their own country?
